- : THis is all very well, but sometimes (quite often actually) a mod does
- : not contain any proper credits , rather just some cryptic phrases that make
- : it hard to contact the author if you wanted to.
-
- In that case, you can't use it. Copyright is implicitly with the author unless
- otherwise stated. Whether you can find the author or even work out who he is
- makes no difference - you can't use it unless you _ask_.
-
- : It also appears to be legal (here in the US at least) to use short samples
- : of original work. Listen to the radio and you'll hear tons of it. Just
- : today I heard a commercial that featured a loop of a Queen song. They
- : simply played the refrain over and over again.
-
- It's not legal without permission. The original composer is entirely within
- his rights to bring a prosecution under such circumstances. In most cases,
- however, they don't bother, either because they just don't mind, can't be
- bothered with the hassle, or don't want to appear to be petty (particularly if
- the sample in question is very small).
-
- : So the legality of this gets very sticky, especially when you consider
- : that many mods use samples from songs to start with.
-
- This is true. Grey areas like this are exactly where lawyers make their money.
- Where plagiarism ends and creativity begins is a tricky line to draw.
-
- : I think a good rule of thumb is to use anything you want for
- : non-profit purposes. If you intend to make money of a product where
- : mods are present you should make every attempt to contact the author.
- : A good way to do this is to post right here in c.s.a.audio.
-
- alt.binaries.sounds.mods[.d] are also sometimes helpful if you're trying to
- track down authors and/or songs. There is also, on Aminet:
-
- modlists.lha docs/misc 67K 83+Nemesis1's Mods-List
-
- which may help you to find out the author of a particular mod. It's getting
- a bit long in the tooth now, though. I've seen the author of this (Nemesis1)
- on IRC a few times. He might have a more up-to-date version, if you can track
- him down.
